- App — the Melee mobile app for Android and iOS.

Provider
The Provider is:
[TO BE FILLED: full company name, registered address, tax ID (NIP), business registration number (CEIDG or KRS)].
Contact: kontakt@melee.pl.
Services covered by these Terms
These Terms cover the Site (the informational pages, the contact form, the beta list and the demo list sign-up) and the App (for Owners and for Drivers).
Technical requirements
Using the Site needs a device with internet access and a web browser. Using the App needs a mobile device running a version of Android or iOS still supported by its maker, and internet access.
Account and email-code sign-in
An App account is created with an email address. Sign-in uses a one-time code sent to that email address — the App needs no password. The Owner is responsible for keeping that email address current and under their exclusive control.
Who may sign up
Only businesses, within the meaning of the Polish Civil Code, may hold an Owner account, created in connection with their business activity. When the Owner is a sole trader entering into an agreement directly related to their business but without a professional character for them, they keep the consumer protections set out in Article 385⁵ of the Polish Civil Code (including unfair-terms review and statutory warranty).
A Driver uses the App free of charge, only on an Owner’s invitation. For a Driver and for any Site visitor, the Provider follows the minimum electronic-service rules of the Polish Act on Providing Services by Electronic Means (UŚUDE), including informing about the risks of using an electronic service and about the right to complain.
The trial and paid plans
After creating an account, the Owner uses the App free of charge and without commitment for a 14-day trial. After that, the Owner can continue on a paid plan, per the current price list on the Pricing page, or stop.
Payment method and billing: [TO BE FILLED: payment method, invoicing rules and billing period — pending payments going live]. Pausing the App outside the season works as described in the current price list.
Owner duties
The Owner is responsible for: the accuracy of the data given at sign-up, lawfully inviting Drivers and their data, and making sure anyone they give account access to follows these Terms.
Availability and liability
The Provider works to keep the Site and the App running without interruption, but does not guarantee uninterrupted availability and may take technical downtime. Toward an Owner acting as a business, the Provider’s liability is limited to actual losses (excluding lost profit) and capped at [TO BE FILLED: a liability cap, e.g. fees paid in the last 12 months].
Complaints
Complaints about the Site or the App can be sent to kontakt@melee.pl. The Provider answers a complaint within 14 days of receiving it.
Termination
The Owner can stop using the App at any time by writing to kontakt@melee.pl. The Provider can terminate the agreement if these Terms are breached, with [TO BE FILLED: a notice period].
Data processing agreement
For driver data and ride data (name, contact details, shifts, rides, GPS positions, and the other fleet data described in the Privacy Policy), the fleet Owner is the controller of the driver and ride data, and Melee processes that data for the Owner as a processor, strictly on the Owner’s documented instructions, to provide the App. This chapter is the data processing agreement within the meaning of GDPR Article 28.
As a processor, Melee agrees to: process data only in the scope and for the purpose the Owner sets, keep appropriate technical and organizational security measures, keep the data confidential, use further sub-processors only as listed in the service table in the Privacy Policy, help the Owner meet its own GDPR duties, and, once the relationship ends, delete or return the fleet data as the Owner instructs.
Changes to these Terms
A change to these Terms gets a new version number. When a change affects how the App may be used, the App asks the Owner and the Driver to accept the new version again at their next sign-in after it takes effect.
Governing law and courts
Polish law governs anything these Terms do not cover. Disputes go to the court with jurisdiction over the Provider’s registered address, to the extent the law allows.
Language versions
These Terms are available in Polish and in English. Both versions are equally binding.
